The Chaos at Manchester Piccadilly

Hi there,

A lot of you I know will of been there when the chaos happened at Manchester Piccadilly and I know a lot of you will of seen 'one man was detained'. Unfortunately that one man was me.

I was trying my hardest to help the young girl infront of me to keep her safe but with all the people pushing behind it was very easy and she was being crushed into the railings.

The BTP didn't take much notice until I started shouting at him trying to get his attention, after a few exchanged words and the railing collapsing, he felt it appropriate to drag me out and put me inside for the night with a Public Order Section 5; Swearing or Aggressive Behaviour towards a police officer, which I now have to try and justify at Manchester Mag Court on 24/3. With my job its the last thing I need getting a criminal record.

If anyone was there, and would be kind enough to write a witness statement about the disgrace of how the police handled it I would be very much appreciated.

Also any images and videos would help, I have gone through all the papers, there is some useful quotes but I want to get as much as I can before the date.

In order to arrest you under section 5, the OB have to warn you to stop using bad language/ behaviour, and for you to ignore the warning.

Not saying you ignored the warning - but if the copper didn't give you that warning, you may have a defense.

Normally they say something like "If you swear at me again, I'll arrest you".

To which you reply, "fuck off", and hey presto, you're nicked.

Prepare for the officers statement to include details of children and frail old ladies who all looked shocked and appalled at your behaviour.

The police told me it was ridiculous and they don't agree with the set up but they're not the enforcing power within their property.

The station CCTV and the recording from the OB should be enough to show they lost control and endangered people.

If they don't include the fact that other members of the public were alarmed or distressed, you may also have a defense, as there is case law that concludes that if the police officer was the only person that heard you, then no offense occurred, as they are deemed to be unshockable by such behaviour....

Possible defenses;

(a) The defendant had no reason to believe that there was any person within hearing or sight who was likely to be alarmed or distressed by his action.
(b) The defendant was in a dwelling and had no reason to believe that his behaviour would be seen or heard by any person outside any dwelling.
(c) The conduct was reasonable.

Might be worth writing to whoever runs the station (Virgin, presumably) if you haven't already, see if they have CCTV which captured anything.
